In the  DDUGJY PIL case, Govt adopts delaying tactics, SIC conducts  farcical probe alleges, Petitoner's advocate

NAHARLAGUN, Sep 14: Advocate Mehmood Pracha for  petitioner Kaku Potom in the public interest litigation (PIL) case no 13/2022 came down heavily on the government for its delay tactics and botch investigation by  the Special Investigation Cell (SIC) which is under the control  of Chief Minister Pema Khandu.
"The Arunachal Pradesh government is engaging in delaying tactics to shield corruption," said Advocate Mehmood Pracha as the Guwahati High Court handed over another date on PIL in the alleged Rs. 142 Cr scam in the Deen Dayal Upadhyaya Gram Jyoti Yojana (DDUGJY). 
We have been trying to solve the case as soon as possible but the state government is trying its best to avoid the hearing and has submitted a 650-page of responses only a day before the hearing. Despite that we have accepted to argue on the acceptance of the case by studying the whole paper within the night, informed Pracha.
Asserting that now the case is more clear, he said that the investigation agency SIC is also helping the accused by going out of the way. "Interestingly the investigation agency is shielding the accused by not doing proper inquiry and appealing to the Court not to initiate an investigation against the officers involved in the corruption," Pracha said adding that the investigation agency has failed to investigate the fake Bank Guarantee, works on the ground, but has only helped the accused.
Moreover, the accused are arguing only on maintainability of the case but not on corruption charges, however, the Court today accepted to hear both admission(Merit) and maintainability of the case in the next hearing.  The High Court has also issued notice to both executing firms --M/s Nirvana Enterprises and M/s DM Group -- to appear before the court regarding the Bank Guarantee and other documents.  

If the government is clean, then they should not play delaying tactics but instead call for free & fair inquiry against all the corruption charges, he added.
The Public Interest Litigation  has been filed in the Guwahati High Court –Itanagar Bench before Justice SK Medhi and Justice Kakheto Sema praying for registering a criminal case as well as a judicial inquiry into the mismanagement of funds meant for the project under the Deen Dayal Upadhyaya Gram Jyoti Yojana (DDUGJY) pertaining to three districts -- West Kameng, Tawang and Namsai worth Rs. 142.74 crore.
