KHONSA, Jun 1: Special Court, POCSO, Khonsa has sentenced a man to 10 years rigorous imprisonment for kidnapping a minor girl and 20 years rigorous imprisonment for raping her, applicable concurrently.
The convict Hok Hana Chakma alias Dhananjoy aged 23 years from Chowkham, Chakma Basti, Namsai district committed the offences in June 2020. The victim, aged about 15 years and a student of Class IX then got in touch with the accused Dhananjoy who was still unknown to her through a phone call which shortly became routine. Dhananjoy successfully created a false impression that he belonged to a well-to-do family owning a bungalow and car and finally on June 23 invited the victim to meet him with the promise to keep her in comfort. The girl realized that she had been trapped, but it was too late. Dhananjoy kidnapped her from Sompoy, the place of meet and raped her in the jungle. Next day, he took her to his thatched house and over the next four days repeatedly violated her. It was only on June 27 the girl’s parents traced her and the following day lodged an FIR at Diyun PS.
SI RK Yein investigated the case and submitted a charge sheet against Dhananjoy for the dual offences of kidnap and rape. On December 31, cognizance was taken against the convict and Special Public Prosecutor N. Hallang examined nine witnesses during virtual hearings. Special Judge H. Kashyap expeditiously completed the trial and delivered the judgment on Monday. Although the convict pleaded that he was in love with the girl and she went willingly with him and also willingly cohabited, the Special Judge averred that a consensual love affair can’t be a defence against the criminal charges of kidnapping a child under 18 years of age and rape as the ‘consent’ of a minor under the eyes of law is not a consent. For the charge of kidnapping Dhananjoy was convicted u/s 366 of the IPC and sentenced to rigorous imprisonment for 10 years. For his other offence which was aggravated and repetitive sexual assault, he was sentenced to rigorous imprisonment for 20 years plus a fine u/s 6 of the POCSO Act.
The case has now been forwarded to the District Legal Services Authority, Changlang for ensuring adequate compensation and rehabilitation to the victim under Arunachal Pradesh Victim Compensation Scheme, 2011. DIPRO
