NEW DELHI, Feb 2: In a major relief to former Deputy Commissioner of ICR Talo Potom(IAS), the Supreme Court on Monday issued notice and stayed the operation of the impugned order passed by the Gauhati High Court in connection with a criminal matter involving petitioner Talo Potom related to abetment of suicide case in Itanagar.
The matter was heard by a Division Bench comprising Justice J.K. Maheshwari and Justice Atul S. Chandurkar while taking up a Special Leave Petition (Criminal) No. 1699 of 2026, arising out of the Gauhati High Court’s final judgment dated 22 January 2026 in CRLP No. 253 of 2025.
Issuing notice in the case, the court recorded that Disha Singh, Advocate, accepted notice on behalf of Respondent No.1 (State of Arunachal Pradesh), while Ms. Lubna Naaz, Advocate, accepted notice for Respondent No.2 (Complainant). The respondents have been granted four weeks to file their counter affidavits.
Importantly, the Supreme Court ordered that the operation of the impugned High Court order shall remain stayed until further orders. However, the court also directed the petitioner to cooperate with the ongoing investigation.
The petitioner has further been permitted to file an additional affidavit raising additional grounds, as prayed.
