Itanagar, Jul 20: The Union Law Ministry on Thursday revealed that there is no proposal to create separate High Courts for the states of Arunachal Pradesh and Mizoram pending with the Central government.
Minister of State for Law and Justice Arjun Ram Meghwal said so in reply to a parliamentary question posed by Senior Advocate and Rajya Sabha Member of Parliament P Wilson.
The Gauhati High Court is currently the common High Court for the states of Assam, Nagaland, Arunachal Pradesh and Mizoram.
With respect to Nagaland, the reply stated that the Chief Minister of the State had conveyed the State Cabinet's decision taken on April 7, 2021 to establish a distinct High Court for Nagaland. It added,
"The proposal for setting up of High Courts for the States of North Eastern Region including Nagaland requires an amendment to the North Eastern Area (Reorganization) Act, 1971. This Act is administered by the Ministry of Home Affairs. The matter has been accordingly sent to the Ministry of Home Affairs.
There is no proposal for separate High Court, from the States of Arunachal Pradesh and Mizoram, pending with the Government."
The reply also revealed that recently, the sanctioned strength of the Gauhati High Court was increased from 24 to 30 judges, with appointment of at least three judges from Nagaland, Mizoram and Arunachal Pradesh.
In his question, Wilson had raised the need for independent High Courts for the States, given that the Gauhati High Court was suffering on account of low manpower and high caseload.
The Ministry said that establishment of new High Courts in states requires consultation with the respective State governments and the High Courts having territorial jurisdiction. (Bar and Bench)
