ITANAGAR, Sep 22: The Gauhati High Court on Friday after keeping reserved the verdict of case filed by Arunachal Pradesh Congress Committee (APCC) in regards to the merger of 43 Congress legislators to the People’s Party of Arunachal (PPA) on September 16 last has entrusted the Speaker of the State Assembly to decide on the validity of the whole process.

The verdict states that, the publication referred In the order dated 16.09.2016 is not a publication of any paper, document, report in connection with the business of the House or laid on the Table of the House or presented to the House or a Committee thereof, In order to bring it within the preview of the Rule-321(1)of the Business Rules and accordingly, the privilege  against any proceeding in any court ,as provided Under Article 194(2) of the constitution, is unavailable.

‘This Court doesn’t’ express any opinion on its merit either  on the validity or the acceptability of such contentions and it would be for the Speaker to consider and decide the same,’ added the verdict.

Former APCC President, Padi Richo had on November 23 last filed a writ petition before the High Court challenging the validity of 43 Indian National Congress (INC) MLAs who merged into the PPA.

Earlier, the Court had issued notice for consideration on the interim relief for stay of the Speaker’s order dated 16-09-2016 by which all the MLA’s have been shown as PPA members and the bulletin dated 16-09-2016 issued by the secretary of the Legislative Assembly notifying them as PPA member.
