ITANAGAR, Jul 19: In a major setback to the state government, the Guwahati High Court today directed the Arunachal Pradesh government to complete the Panchayat  election process  by  November 30.

Responding to the writ petition filed by the General Secretary of All Arunachal Pradesh Panchayat Parishad (AAPPP), Sangha Tagik, the Guwahati High Court  in its   directives  stated  that  ‘ a writ of mandamus is hereby issued  to avert a Constitutional  crisis in the state, directing the Government of Arunachal Pradesh  to suitably revise its action  plan so as to complete the exercise by  November 30 and thereafter, the State Election Commission  shall start its exercise for holding the  general election to the Panchayati Raj institutions. Writ of mandamus is further issued directing the Government of Arunachal Pradesh and its functionaries  to render all co-operation and assistance to the State Election Commission in discharging its Constitutional obligation of holding a smooth and fair election.’

Moreover, in Para 37 of the judgment, it also stated that ‘the entire process shall not continue beyond 31-12-2018, keeping in mind that the mandate of the Article 243 E(3)  of the Constitution  of India  cannot be diluted by introducing  an amendment to the statutory laws on the subject.

While confirming the report, General Secretary AAPPP, Sangha Tagik informed  this daily over phone that being the  executive member of the Panchayat Parishad  he had lodged case with the Guwahati High Court on May last.  ‘Though I haven’t received the hard copy yet, my lawyers have already shared the judgment,’ he added.

The term of Panchayat bodies in the state has already expired on April 13 last.
