ITANAGAR, Mar 7: Secretary, State Legislative Assembly today issued a fresh notice claiming the Assembly Constituency of 12 Pakke- Kessang has fallen vacant and Kameng Dolo has ceased to be a member of the Sixth Arunachal Pradesh Legislative Assembly.
This comes close at the heels of the judgment and order dated 8 February 2017 of the Guwahati High Court in Election Petition No. 2 of 2014 ( Atum Welly Vs Kameng Dolo) declaring the election of MLA, Kameng Dolo from 12 Pakke-Kessang (ST) Assembly 'Constituency as void under section 100(1)(d)(iv) of the Representation of the People Act, 1951.
Speaking to this daily, Former Minister Atum Welly informed that he has already approached the Election Commission of India, Guwahati High Court and even the State Election Commission to declare the said constituency as vacant and announced the re-election as per prescribed norms.
‘Moreover, it is clear that Dolo had tried to get stay from Supreme Court but failed. So, I appeal the State Election Commission and other authority concern to do the needful within stipulated time frame. As per norms commission has to declare the election within one month,’ he added.
Earlier, Guwahati High Court on February 8 last had rejected interim stay on the judgment passed by the single bench Judge of Guwahati High Court declaring the election process of 12th Pakke Kesang Assembly Constituency held on 2014 as void.
Welly had filed a petition claiming that he had not withdrawn his candidature from the 2014 elections and that his signature was forged, that led to Dolo being elected unopposed.
Former MLA Kameng Dolo could not be reached for his comment on the latest development.
